First edition of this lithographically printed work, an essential register of distinguished Confucian scholars, military generals, and eminent officials during the reign of King Kojong (1852-1919; r. 1864–1907). As an exhaustive compilation of the achievements and contributions of key figures in late Chosŏn intellectual and official circles, this book provides important reference for the study of modern Korean history. Its compilation and publication in 1936 reflects a broader effort in Korea during the Japanese colonial period (1910-45) to preserve, document, and assert national identity through the commemoration of “virtuous” figures and traditional institutions from the recent past. The emphasis on scholarly and familial lineages upholding Confucian values of loyalty and filial piety from the era under the final monarch of a sovereign Korean state aimed to provide models of moral conduct, maintain a record of indigenous achievement, and offer a source of continued pride for an old Korean elite facing rapid cultural and political change. Not much is known about the compiler, Song Hyŏn-su. His Preface discusses the register’s extensiveness and why such records are important: “During the fifty years of King Kojong’s reign, from high ministers down to humble officials, all ranks are included in detail, making them accessible for reference. Both civil and military officials of the three main classes, whether serving at court or in the provinces, are all accounted for in this compilation; a thorough reading of this register leaves nothing omitted or confused. Since time passes and generations fade, it would be regrettable if the families of scholar-officials were unable to preserve their lineage — hence, it is imperative that such records be compiled.” There is an additional Preface written by a former Chosŏn official and historian Yoon Young-gu 尹寗求 (1868-1941). He reminisces: “During the ten years of meritorious service in King Kojong’s reign, many rose to high rank — such loyalty and prominence were not unseen. Yet, ever since laying down my bow, I have lived humbly as a commoner, occasionally gazing upon the royal palace and, unaware, sighing deeply with nostalgia.” Fine set and rare. n.p.: n.p., 1784. FIRST EDITION. Woodcut chapter headings, folding table. Contemporary calf-backed boards, gilt spines; an excellent set. First edition, possibly the first printing, of Necker’s famous work on the financial health of France. A very interesting and possibly unique copy, bibliographically. The collation differs from every copy we have examined. These volumes were printed from a smaller set of type and thus contains fewer leaves though the text is exactly the same in virtually all other copies of the first edition found. It is also an earlier printing as many of the other copies we looked at have the few errata items corrected. Necker (1732-1804) was opposed to raising taxes and instituted loans at high interest rates to help with the French debt. At the time of the American revolution, which was very popular with nearly all the French population, Necker warned against the consequences of use of government bonds to fund its assistance to the Colonies, a very unpopular position. Nevertheless he was blamed for France’s high debt. With the massive amounts spent by the royal family, Necker asked to be brought into the royal council, but was rebuffed because of his Calvinist leanings. It was in 1781 that he published the country’s budget, unheard of at the time, especially under a monarchy. He was then dismissed as minister of finance, which upset a large segment of the people because of his popularity. He spent the next few years writing this book, which sold thousands of copies, pointing out how France had accumulated so much debt and his suggestions for reform. "[T]he Eleventh Amendment, which restrains the jurisdiction granted by the Constitution over suits against States, is, of necessity, limited to those suits in which a State is a party on the record." Ohio levied taxes on each branch of the U.S. Bank in the state. The Court had already ruled in McCulloch v. Maryland that such taxes were unconstitutional, but Ohio persisted in enforcing the tax. Ralph Osborn, the State Auditor, seized funds from the Bank. The circuit court ordered Osborn and his colleagues to repay the amount seized. The question is Osborn was, did the federal circuit court's assertion of jurisdiction violate the Eleventh Amendment? In a 6-to-1 decision, the Court upheld the circuit and ruled that the Ohio law was "repugnant to the Constitution." Osborn and his colleagues were thus "incontestably liable for the full amount of the money taken out of the bank." This issue includes a first printing of the landmark Supreme Court decision in the case of Osborn et al. v. The Bank of the United States. The Bank of the United States fills pages 3 and 4. 4 pp. Excerpts: "At the close of the argument, a point was suggested, of such vital importance, as to induce the Court to request that it might be particularly spoken to. That point is, the right of the Bank to sue in the Courts of the United States. It has been argued, and ought to be disposed of, before we proceed to the actual exercise of jurisdiction, by deciding on the rights of the parties. "The appellants contest the jurisdiction of the Court on two grounds: "1st. That the act of Congress has not given it. "2d. That, under the constitution, Congress cannot give it." (p3/c1) "The act of incorporation, then, confers jurisdiction on the Circuit Courts of the United States, if Congress can confer it." (p3/c2) "We perceive, then, no ground on which the proposition can be maintained, that Congress is incapable of giving the Circuit Courts original jurisdiction, in any case to which the appellate jurisdiction extends." (p3/c2) "The eleventh amendment of the constitution has exempted a State from the suits of citizens of other States, or aliens; and the very difficult question is to be decided, whether, in such a case, the Court may act upon the agents employed by the State, and on the property in their hands." "Consequently, the 11th amendment, which restrains the jurisdiction granted by the constitution over suits against states, is, of necessity, limited to those suits in which a State is a party on the record." (p4/c3) Historical Background During the Banking Crisis of 1819, many banks, including the Second Bank of the United States, demanded repayment of loans, leading to a shortage of money. In February 1819, the Ohio state legislature passed a law to collect a tax on any banks operating within the state contrary to the laws of the state. It also authorized state Auditor Ralph Osborn (1780-1835) to charge $50,000 for each office of any such bank after September 15, 1819, and to seize assets to pay such taxes. On September 14, 1819, the Bank obtained an injunction in the U.S. Circuit Court of Ohio to prohibit Osborn from seizing funds from a branch of the Bank in Ohio. Despite the injunction, Osborn's agents seized $100,000 from the Bank at Chillicothe on September 17 and placed $98,000 in the state treasury. Osborn used the remaining $2,000 to pay his agents. The Bank sued Osborn and the state treasurer for the return of the money, and the U.S. Circuit Court ruled against Osborn and the treasurer and ordered them to restore the $100,000 to the bank, with interest of $19,830. The circuit court ruled that Osborn had violated a court order, which prohibited the taxing of the bank. Ohio defended its injured sovereignty, endorsing the Virginia and Kentucky Resolutions of 1798. The stage was set for a classic confrontation between the claims of state sovereignty and federal supremacy. In March 1819, Chief Justice Marshall's Opinion for the unanimous Court in McCulloch v. Maryland had established that Congress had power to create the Bank of the United States, and that State taxation of the Bank was unconstitutional. Ohio sought to skirt McCulloch by arguing that the Eleventh Amendment blocked the Bank's suit against Osborn because he was a state official and acted for the state. Osborn then appealed to the U.S. Supreme Court and argued that the U.S. Circuit Court should not have exercised jurisdiction over the case because Congress did not give it that right and that Congress could not give it that right under the restrictions imposed by the Eleventh Amendment. The Eleventh Amendment, passed by Congress in 1794 and ratified by the necessary number of states in 1795, gave states sovereign immunity against suits by citizens of another state or citizens or subjects of a foreign country. In March 1824, Chief Justice Marshall, in his opinion for a majority of six, quickly disposed of both objections to the jurisdictional questions. The Court held that Congress could grant original jurisdiction to federal courts in any case arising from federal laws, treaties, or the Constitution, and that the Eleventh Amendment applied only to states and not to their agents and officials such as Osborn. The Court ruled in favor of the Bank and ordered the state treasurer to return the $98,000 and Osborn to return the additional $2,000 though not the interest awarded by the Circuit Court. Associate Justice William Johnson (1771-1834) of South Carolina dissented from the Court's decision. Appointed by President Thomas Jefferson in 1804, Johnson developed a reputation as a frequent and articulate dissenter from the Federalist majority under John Marshall. Johnson insisted that Congress could not create federal jurisdiction just by granting the right to sue in federal court. The cause of action had to arise under federal law. Additional Content This issue also includes "An Act to define the boundary line between the Edwardsville and Springfield Land Districts, in the state of Illinois," signed in type by President James Monroe, Speaker of the House of Representatives Henry Clay, and Vice President and President of the Senate Daniel D. Tompkins (p2/c1); the proceedings of Congress (p2/c2-3); a notice that because of the great length of the decision in Osborn et al. v. The Bank of the United States, it would not appear in the three-times-a-week edition, but copies would be available at the newspaper's office for five cents (p2/c5); an advertisement for a meeting of the Board of Managers of the American Colonization Society (p2/c5); an offer of a $10 reward for the return of a young slave woman who had run away from a Virginia owner (p1/c4); and other advertisements and notices. John Marshall (1755-1835) was born in Virginia, and served in the Continental Army during the Revolutionary War. Furloughed in 1780, he began attending the College of William and Mary, where he read law with George Wythe. He won election to the Virginia House of Delegates in 1782 and practiced law in Richmond. He strongly favored the new federal Constitution and served in the Virginia ratifying convention of 1788. A strong Federalist, he accepted appointment as part of a three-member commission to France in 1797 that ultimately led to the XYZ Affair and the Quasi-War with France. Marshall won election to Congress in 1798 and took office in December 1799. In May 1800, President John Adams appointed him as Secretary of State, and Marshall negotiated an end to the Quasi-War. In the final months of his presidency, Adams nominated Marshall as Chief Justice of the U.S. Supreme Court, and Marshall took office in February 1801. As Chief Justice over the next thirty-four years, Marshall established the Supreme Court as a co-equal branch of the federal government, and he personally wrote about half of the more than one thousand opinions handed down by the Court during his tenure. National Intelligencer (1800-1870) was a prominent newspaper published in Washington, D.C. In 1800, Thomas Jefferson, then vice president and a candidate for the presidency, persuaded Samuel Harrison Smith, the publisher of a Philadelphia newspaper, to open a newspaper in Washington, the new capital. Smith began publishing the National Intelligencer, & Washington Advertiser three times a week on October 31, 1800. In 1809, Joseph Gales (1786-1860) became a partner and took over as sole proprietor a year later. From 1812, Gales and his brother-in-law William Winston Seaton (1785-1866) were the newspaper's publishers for nearly fifty years. From 1813 to 1867, it was published daily as the Daily National Intelligencer and was the dominant newspaper of the capital. Supporters of the administrations of Thomas Jefferson, James Madison, and James Monroe, Gales and Seaton were the official printers of Congress from 1819 to 1829. From the 1830s to the 1850s, the National Intelligencer was one of the nation's leading Whig newspapers, with conservative, unionist principles. Condition Loosened at spine, scattered light foxing. Newspaper published 15 issues between 1957 and 1965 and is best remembered today for almost single-handedly establishing the reputation of William Gaddis's THE RECOGNITIONS through Green's thorough and devastating deconstruction of the novel's negative reviews (originally published in Newspaper 12-14, reprinted as FIRE THE BASTARDS in 1992), as well as (most infamously) his 1962 full-page ad in the Village Voice extolling the work's virtues. "[P]art conceptual art, part political tract, and part 'zine [...] 'Green' [a psuedonym] used his underground tabloid for cultural commentary and deliciously satirical (yet superbly well-documented) assaults" (Clay and Phillips p. 77). A very fragile production of which not many survived. Indeed, the first copy we've handled in many years of looking. Wraps. Tall 4to. Top-stapled legal-sized mimeo. Heavily toned. Fairly brittle. "Two for the Seesaw" opened on January 16, 1958 at the Booth Theatre for a highly successful run of 750 performances, closing on October 31, 1959. The play was an unexpected hit, marking the debut of three exceptional talents, playwright William Gibson, actor Anne Bancroft, and director Arthur Penn (who was nominated for a Tony Award). The following year, the three would go on to write, star, and direct, respectively, the 1959 Tony Award winning play "The Miracle Worker," as well as subsequently adapting it for the 1962 Academy Award Winning film. Jerry Ryan (Fonda) leaves his wife and law career in Nebraska and moves to New York, where he meets struggling dancer Gittel Mosca (Bancroft), beginning a precarious relationship. Three volumes 9 1/2 inches tall, each in paper wraps with title handstamped to covers and hand printed ink titles to spines. Bookplate of Robert L Chevalier MD to front free endpaper. Text uncut, unmarked. Many tables and phylogeny diagrams. Hand stamp of Leigh Van Valen to inside cover and title page of each volume. Vol. I, i-xv, 400 pp; Vol. II, i-xviii, 720 pp; Vol. III, i-xx, 660. Other than noted on the covers and preliminary pages, the text is unmarked and appears unread with light browning to pages. However, the glue binding has dried, and many of the signatures are loose. Very good minus in custom archival mylar covers. ERNST HAECKEL (1834-1919) was a German zoologist, naturalist, eugenicist, philosopher, physician, professor, marine biologist and artist. He discovered, described, and named thousands of new species, mapped a genealogical tree relating all life forms and coined many terms in biology, including ecology, phylum, phylogeny, and Protista. Haeckel promoted and popularized Charles Darwin's work in Germany and developed the influential recapitulation theory: "ontogeny recapitulates phylogeny." He postulated that evidence of human evolution would be found in the Dutch East Indies (now Indonesia). At that time, no remains of human ancestors had yet been identified. Eugène Dubois searched the East Indies from 1887 to 1895, discovering the remains of Java Man in 1891, consisting of a skullcap, thighbone, and a few teeth. These remains are among the oldest hominid remains ever found. Dubois classified Java Man with Haeckel's Pithecanthropus label, though they were later reclassified as Homo erectus. REVIEW of Vol I in The Monist, Vol. 5, No. 3 (April, 1895), pp. 451-452: "The reader will find incorporated here the results of thirty years of fruitful research. Professor Haeckel's point of view has remained practically the same as when he first promulgated the idea. It is his aim to reach a scientific knowledge of the organic forms and of the causes that produce them by a study of the causal relations obtaining between phylogeny and ontogeny, the history of the race and the history of the individual. The present work is not a text-book, but presupposes considerable knowledge of natural history on the part of its readers. Nevertheless, Professor Haeckel's style is delightfully lucid, and what with his explicit explanations of new terms and his profuse use of diagrams and counter-references, the intelligent reader who has access to a good compendium of natural history will not only have no difficulty, but will experience considerable pleasure, in the perusal of portions of this work. The volume before us treats of Protists and Plants, and is to be followed before the close of the year by the two other parts on vertebrate and invertebrate animals." PROVENANCE: LEIGH VAN VALEN (1935 - 2010) was professor emeritus in the Department of Ecology and Evolution at the University of Chicago. Amongst other work, Van Valen's proposed "Law of Extinction" drew upon the apparent constant probability (as opposed to rate) of extinction in families of related organisms. Van Valen proposed the Red Queen Hypothesis (1973), as an explanatory tangent to the Law of Extinction. Van Valen also defined the Ecological Species Concept in 1976, in contrast to Ernst Mayr's As a graduate student at Columbia, he studied under George Gaylord Simpson and Theodosius Dobzhansky, both giants in honing the synthetic theory of evolution, which melded Darwin's ideas about evolution with Mendel's on genetics.

(1880s); oblong 4 x 7; chromolithographed illustration to recto, text to verso; mild age-toning to verso, else minor wear - in very good or better condition. With the classic nursery rhyme re-written as an advertisement for the American Shoe Tip Company - the trade card touted the benefits of children's black-tip shoes. The verso of the card advertised a shoe dealer, who carried these shoes - J. T. Fitzgerald of Ware, Massachusetts.
